On March 15, 2012, Tim Cavanagh of Cavanagh Law Group filed a wrongful death lawsuit against the Village of Westchester and an Illinois State Trooper for the death of Diana Paz on September 2, 2011. The lawsuit accuses defendants of failing to protect the intoxicated young mother while she was in their custody. Paz leaves behind a 5 year-old son, Erik Martinez. The case is titled Maria Guerrero and Raul Martinez, as Co-Special Administrators of the Estate of Diana Paz, deceased v. Village of Westchester and Krzysztof Piotrowski, case number 2012 L 002872.
