Hospital's Alleged Failure to Act on Signs of Dangerous Birth Results in Wrongful Death Lawsuit

/

Doctors and hospitals have a legal duty to account for a patient's medical history and specific symptoms when providing treatment. If a medical provider fails to notice and properly treat symptoms that suggest a routine procedure may have complications, they can be held legally responsible for any injuries that were caused by their negligence.

All patients are different, and doctors are trusted to use their expertise to identify possible complications that may arise based on a patient's symptoms and medical history. Although each patient cannot receive the most desired result for every course of treatment, doctors are held to a high professional standard of care, which requires all patients to receive at least the level of care that is acceptable to the medical community when considering the individual patient.

Chicago Man Filed Malpractice Lawsuit Based on Wife's Death After Childbirth

One example of a lawsuit that may be filed after a doctor fails to notice symptoms of complications that may arise after a common procedure has recently been filed in Cook County. According to a local news report, the plaintiff in the recently filed case is a man whose wife passed away shortly after giving birth to a child while under the care of the defendants. The man alleges that the doctors failed to properly treat his wife during the childbirth, based on the symptoms she demonstrated upon arrival to the hospital.

Evidently, the man's wife had allegedly told the defendants that she had been experiencing blood clots and vaginal bleeding when she arrived to give birth at the hospital on November 18, 2013. The doctors delivered the child, although the woman developed postpartum bleeding after the procedure. The patient was given a hysterectomy and a blood transfusion to treat her bleeding, but she later died despite the treatment.

It was later discovered that the patient’s essential organs had been deprived of blood for too long. The complaint suggests that the doctors treating her were negligent in not foreseeing the type of harm that occurred and in failing to provide her with the appropriate treatment after the fact. This lawsuit was only recently filed, and an outcome is still several months if not years away.
