What should I do if I was involved in a car accident?
Call the police immediately and report the accident: Even if the damage was minor, it is essential to your case to have a
detailed police report of what happened.
Take photos at the scene: While the police will provide their own report, taking photos of the scene
right after the accident occurred can support your side of the story.
Report the accident to your insurance company as soon as possible: Some insurance companies limit the amount of time you have to report
an auto accident. Report the incident to your insurance company as quickly
as you can, but
DO NOT admit fault for the accident. Your testimony could be used against you later.
Visit a doctor as soon as possible: It is essential to your insurance claim and personal injury lawsuit to
have a medical professional document and report your injuries. More importantly,
car accidents can cause serious injuries that you may not feel right away.
A medical professional can thoroughly examine your injuries and make sure
you receive proper medical treatment.
Hire a car accident lawyer to maximize your compensation: It takes an experienced, well-resourced researcher and investigative team
to get to the bottom of a car accident, identifying all the parties at
fault, and holding them accountable. Cavanagh Law Group is ready to fight for you!
How long do I have to file a personal injury lawsuit?
In the state of Illinois, you have
two years from the date of the accident to file a lawsuit in civil court.
If your injury claim is against the municipal government for a city or
county, you only have one year to file your claim. It is recommended that you file a lawsuit as soon as possible after the
accident since delaying for a long period of time might convey that you
aren't really as injured as you seem. We don't want anything to
come between you and the compensation you deserve.
Can I still recover compensation if I was partially at fault for the accident?
The simple answer is yes. The state of Illinois abides by the law of comparative negligence, which
allows injury victims to receive compensation even if they are proven
to be partially at fault for the accident. Read more in our
Journal about comparative negligence.
