What should I do if I was involved in a car accident?
Call the police immediately and report the accident: Even if the damage was minor, it is essential to your case to have a
detailed police report of what happened.
Take photos at the scene: While the police will provide their own report, taking photos of the scene
right after the accident occurred can support your side of the story.
Report the accident to your insurance company as soon as possible: Some insurance companies limit the amount of time you have to report
an auto accident. Report the incident to your insurance company as quickly
as you can, but
DO NOT admit fault for the accident. Your testimony could be used against you later.
Visit a doctor as soon as possible: It is essential to your insurance claim and personal injury lawsuit to

How long do I have to file a personal injury lawsuit?
In the state of Illinois, you have
two years from the date of the accident to file a lawsuit in civil court.
If your injury claim is against the municipal government for a city or
county, you only have one year to file your claim. It is recommended that you file a lawsuit as soon as possible after the
accident since delaying for a long period of time might convey that you
aren't really as injured as you seem. We don't want anything to
come between you and the compensation you deserve.
Can I still recover compensation if I was partially at fault for the accident?
The simple answer is yes. The state of Illinois abides by the law of comparative negligence, which
allows injury victims to receive compensation even if they are proven
to be partially at fault for the accident.
According to comparative negligence laws, the parties involved are referred
to as the insured and the claimant. When both parties are determined to
be at fault in an accident, the insurance company will determine the liability
for damages. An injured party can recover compensation only if that driver
is less than 50% at fault for the damages or injury. However, the amount
the insured party recovers can be reduced in proportion to the degree
the injured party was at fault.
To resolve comparative negligence, an insurance company will make an offer
to the injured party based on what the insurance company believes to be
the amount of negligence of its insured. To determine the amount of this
offer, the insurance company may consider the following:
- Interviews with involved parties
- Interviews with witnesses
- The accident report
If the insurance company believes that its insured was not at least 50%
at fault for the collision, the insurance company will not offer to provide
compensation for the loss. However, an insured party may be able to negotiate
with the insurance company until a settlement is reached. If a settlement
is not reached, the court will make a final determination of competitive
